Enquanto por Macau há advogados que se manifestam compreensivos, para não dizer que apoiam, a nova Lei da Segurança Interna de Hong Kong, por lá os advogados, incluindo os que são tradicionalmente pró-Pequim, apontam as suas dúvidas e temores face ao que acabou de entrar em vigor.

Os receios manifestados pelos meus colegas de Hong Kong merecem ser conhecidos, quer para que lhes possa ser manifestada a nossa solidariedade, enquanto advogados e cidadãos preocupados com o Estado de Direito e as suas garantias, quer para que depois não se façam tristes figuras.

Statement of the Hong Kong Bar Association

"(...) Taken together, these and other provisions of the NSL operate to erode the high degree of autonomy guaranteed to the HKSAR under the Basic Law and the Sino-British Joint Declaration, and to undermine core pillars of the One Country Two Systems model including independent judicial power, the enjoyment of fundamental rights and liberties, and the vesting of legislative and executive power in local institutions. The Hong Kong Bar Association calls on the Chief Executive to reaffirm these foundational values of the HKSAR, and to commit her Government to applying the NSL in a manner that is fully consistent with the Basic Law and Hong Kong Bill of Rights."

National Security Legislation Further Observation

"According to the Explanation, among other things, the Chief Executive of the HKSAR (“CE”) will designate (指定) current or former judges or magistrates at any level to handle cases concerning national security. We express concern that such process of designation of judges would give the CE the power to oversee and interfere with the Judiciary. That (or the perception arising therefrom) prejudices judicial independence. Judicial independence is a cornerstone of our justice system within a common law jurisdiction, and cannot be compromised."
